Terms and Conditions of Fine Art Academy Cologne

1. Validity

All services and offers of the Fine Art Academy Cologne (hereinafter: “FAAC”) are provided exclusively on the basis of these General Terms and Conditions. These are an integral part of all contracts that FAAC concludes with students or course participants regarding the services it offers. They shall also apply to all future FAAC services, even if they are not separately agreed again.

2. Services

2.1 FAAC offers the following services:

Full-time and part-time studies comprise the following course units, depending on the agreement:

2.2 Full-time and part-time studies can be taken up at the beginning of each trimester after consultation with the FAAC and include the booked contingent of hours (full-time studies: 6 hours/4 days/week; part-time studies: 6 – 18 hours/week).

2.3 The introductory/orientation courses comprise a contingent of 15 teaching hours and can be taken at any time after individual agreement with the FAAC.

2.4 Weekly courses (depending on offer), nude drawing and workshops (depending on offer) can be booked separately and independently of the admission to full-time and part-time studies at the times offered.

3. Registration; contract period

3.1 Registration for full-time and part-time studies as well as for introductory/orientation courses takes place via the online registration form. The FAAC examines the submitted works and then invites you to a meeting. A binding contract will only be concluded after the date of the meeting. The registration for the act drawing takes place by email to info@fineartacademycologne.com, and for the weekend courses and/or Workshops depending upon announcement.

3.2 Full-time and part-time studies are carried out for a minimum contract duration of 3 trimesters.

3.3 The FAAC reserves the right to reject registrations in individual cases.

4. Opening hours/lesson hours

4.1 The opening hours and lesson times are shown on the homepage.

4.2 No lessons take place on public holidays.

5. Fees

5.1 The agreed fees shall apply for the services booked.

5.2 In the case of registration for full-time and part-time studies, the agreed monthly fees are due on the 20th of each month of the agreed term. Payment must be made by direct debit or bank transfer to the FAAC account at Sparkasse KölnBonn. In the event of registration for an introductory/orientation course or a workshop, the one-off fee is due immediately upon conclusion of the contract. The one-off fee must be paid by bank transfer to the FAAC account at Sparkasse KölnBonn.

5.3 In the event of payment arrears, FAAC will charge a flat-rate reminder fee of € 10.00. In addition, the statutory default interest will accrue with the occurrence of the delay in payment. If payment is more than 2 months in arrears, all fee claims for the agreed contract period will become due immediately in the event of registration for full-time and part-time studies.

6. Materials

6.1 Unless expressly agreed otherwise, the student or course participant must bring or use his/her own material (e.g. canvas, paper, brush, paint).

6.2 The student or course participant undertakes to handle the equipment provided by FAAC, including working materials etc., with care at all times.

7. Cancellations

7.1 FAAC shall be entitled to cancel or postpone the execution of individual courses or events – even at short notice – for good cause. This shall apply in particular in the event of illness or sudden prevention of a lecturer, insofar as no replacement can be provided or if the number of participants for individual course units falls below a minimum of 5. Courses or events cancelled by the FAAC will be made up for in consultation with the student or course participant.

7.2 If a student or course participant is unable to attend a course unit, he must notify FAAC of this in writing in good time, but at least 1 working day in advance.

8. Rights to documents provided etc.; rights of use to photos and video recordings

8.1 FAAC reserves all rights, in particular property rights and copyrights, to all documents, drawings, pictures, photographs, illustrations, templates and other documents which FAAC makes available to students or course participants within the framework of the teaching units. The passing on to third parties or reproduction of these documents is only permitted with the express written consent of FAAC.

8.2 The student or course participant agrees that FAAC may use photos and videos, which may be taken in the context of lessons etc., for advertising purposes, e.g. on the FAAC homepage or on video portals on the Internet. The consent is irrevocable and free of charge.

9. Liability

FAAC shall be liable within the framework of the statutory provisions for damages resulting from injury to life, body or health as well as for the breach of essential contractual obligations. FAAC shall be liable for other damages insofar as these are based on a grossly negligent or intentional breach of duty by FAAC or an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of FAAC. In all other respects, liability is excluded.

10. Final provisions

10.1 The place of performance for all obligations arising from the business relationship is Cologne.

10.2 The law of the Federal Republic of Germany shall apply.

10.3 FAAC collects and processes the personal data of the student or course participant in accordance with the applicable data protection law. Details can be found in the data protection declaration on the FAAC website.

10.4 Should any provision of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
